Welcome to InstaPaid! These Terms and Conditions govern your use of our earned wage access services. By using our services, you agree to these Terms and Conditions.
Application & Introduction
The Terms and Conditions apply to all usage related to the application of the platform provided by InstaPaid ApS, CVR number: 43769359 (Referred to InstaPaid from here on).
The website “instapaid.io” and the mobile application “InstaPaid” are operated by InstaPaid. InstaPaid is a platform that enables users to instantly withdraw earned salary outside of the normal pay cycle, along with any additional accrued amounts (such as mileage, expenses, or tips) depending on their employer’s setup.
General Terms
Eligibility. You must be an employee of an eligible employer to use our services. You agree to provide us with accurate and up-to-date information about yourself.
Earned Wage Access. Our services enable you to access your earned wages before your regular payday. Depending on your employer’s agreement with InstaPaid, this service may be offered free of charge or subject to a transaction fee. If a fee applies, it will be clearly communicated to you in the InstaPaid app before confirming a withdrawal. This fee will be charged by and paid directly to your employer, deducted from your salary.
Privacy Policy. Our Privacy Policy governs our collection, use, and disclosure of your personal information. By using our services, you agree to our Privacy Policy.
Prohibited Activities. You agree not to use our services for any illegal, fraudulent, or unauthorized purpose. You also agree not to interfere with the operation of our services or access our services in an unauthorized manner.
The Product
The product delivered by InstaPaid enables employees to instantly withdraw earned and accrued salary outside of the normal pay cycle. Depending on your employer’s setup and integrated systems, you may also be able to withdraw accrued mileage, expenses, tips, or other supplements.
InstaPaid performs these payouts on behalf of your employer, who remains responsible for ensuring that payments correspond correctly to hours worked and any additional accrued amounts (such as mileage, expenses, or tips).
By creating an InstaPaid account and making a withdrawal, you authorize InstaPaid and your employer to deduct all amounts related to these withdrawals from your next salary payment.
To ensure the security of payment claims related to InstaPaid transactions, you must accept the specific Terms & Conditions prior to using our services.
Your Account
You must create an account to use our services. You agree to provide us with accurate and up-to-date information about yourself, and to keep your account information confidential.You are responsible for maintaining the security of your account, including your login credentials.
You agree to notify us immediately of any unauthorized use of your account.
Account Termination. We reserve the right to terminate your account at any time, with or without cause, and with or without notice. You may also terminate your account at any time by contacting us at [email protected].
Security
All data communicated between InstaPaid and your device is encrypted.
All transactions are automatically checked against reported data from your employers software systems (including, but not limited to payroll, time-and-attendance, workforce management, HCM systems, Tax data) and measures agreed between InstaPaid and the employer, such as withdrawal limit.
The bank account used for InstaPaid withdrawals is provided by your employer. Any changes or updates to this account must be made directly through your employer.
You acknowledge and agree that neither InstaPaid nor its employees or other related parties are liable in any way for any direct, indirect, consequential or other loss or damage which may arise in connection to third party access to your InstaPaid account.
Communications
InstaPaid will provide you with important updates via the email address provided in your account (e.g. changes to Terms & Conditions and receipts of withdrawals) InstaPaid will also send you relevant information about new features, newsletters, and other direct communications that is relevant to the whole user experience. You are always able to unsubscribe from this type of communication.
Rights and Liability
InstaPaid holds all rights to our products and services. We own all intellectual property rights in our services, including our website, mobile applications, and other software. including the website, the application, and all other material on InstaPaid’s website or application. This includes, but is not limited to, copyrights, proprietary rights, and trademark rights to InstaPaid’s products and services.
We grant you a limited, non-exclusive, non-transferable license to use our services for your personal, non-commercial use.
You agree not to copy, modify, distribute, or reverse engineer our services.
Operations
InstaPaid aims to avoid errors, defects and disruptions of service on the Web and the App at any time, but this may occur. InstaPaid will try to fix any issues as quickly as possible.
InstaPaid performs ongoing maintenance and updates on both the website and the application. During maintenance, certain or all features may become temporarily unavailable.
InstaPaid is not liable to you in the event of errors, defects, malfunctions, or removal of functionality.
Termination
If you disagree with the Terms and Conditions and/or the Terms of Use or for any other reason no longer wish to use InstaPaid, you can delete your account at any time.InstaPaid may at any time and without notice suspend or terminate your agreement regarding the use of InstaPaid’s product and service and, if necessary, delete your profile (e.g. in cases of unacceptable use, attempt to abuse other users’ accounts, attempt to access other users’ data or other illegal or improper behavior)
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws in Denmark where InstaPaid is registered, without giving effect to any principles of conflicts of law.
Dispute Resolution
Any dispute arising out of or in connection with these Terms and Conditions shall be resolved through arbitration in accordance with the rules of the European Union’s arbitration association.
Translations
This Agreement may be translated into other languages for convenience. The English language version shall be the governing version of this Agreement. In the event of any discrepancy, inconsistency, or conflict between the English version and any translated version, the English version shall prevail.
Changes to These Terms and Conditions
We may update these Terms and Conditions at any time. We will notify you of any changes by posting the updated Terms and Conditions on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms and Conditions.
If you do not agree to the changed Terms and Conditions, you will no longer be able to use the Website or the Application, and InstaPaid is entitled to delete your profile.
